Anti-Hate and Extremism Laws in Australia Expand ASIO Powers

Australia’s Federal Government has introduced new draft legislation to strengthen anti-hate and extremism laws, proposing expanded powers for the Australian Security Intelligence Organisation (ASIO) to recommend designating groups as hate organisations, with significant implications for national security enforcement and community protection.

Under the draft bill, ASIO would be empowered to advise on the designation of organisations that promote hate crimes or vilification, potentially exposing individuals and leaders associated with such groups to criminal penalties of up to 15 years’ imprisonment for directing activities or supporting extremist conduct. The proposal lowers the threshold for designating hate groups compared to existing terrorist laws, focusing on conduct and advocacy that incites hatred, even without formal membership or domestic registration.

In response, some groups targeted by the legislation, including a neo-Nazi collective, have announced intentions to disband ahead of the law’s parliamentary introduction. However, security officials have warned that extremist actors may seek to continue operating underground, challenging enforcement and surveillance efforts.

The draft bill also provides legal defences for individuals who demonstrate they attempted to leave a designated group once aware of its flagged status. In addition to empowering ASIO, the legislation includes a major gun buy-back scheme and broader measures to disrupt recruitment, training and financial backing for extremist activities.

For security professionals and risk leaders, these proposed changes signal a potential shift in how extremist conduct is identified, designated and countered, with strengthened legal tools, greater enforcement capacity and heightened expectations for preventive intelligence cooperation across law enforcement and the security industry.
